Child Care Provider Agreement GENERAL TERMS OF AGREEMENT 1. The Provider and Children’s Village of Ottawa-Carleton (the “Agency”) agree that the Provider will provide home child care services in accordance with this agreement. 2. The Provider acknowledges having received a copy of the Agency Provider Handbook for Home Child Care and agrees to provide home child care in accordance with the policies and procedures outlined in the handbook. 3. The Provider further acknowledges that this arrangement is entered into, in accordance with the licensing requirements of the Child Care and Early Years Act and other prescribed legislative requirements, and that the Agency has the authority to require that the Provider comply with these obligations. 4. The Provider understands and agrees that this Agreement does not create an employment relationship with the Agency and that the Provider is entering into this Agreement as a self-employed independent contractor. It is understood that the Agency does not provide the Provider with employee benefits of any nature. RESPONSIBILITIES OF THE AGENCY 5. The Agency will supply to the Provider the following: Access to the current copies of the Child Care and Early Years Act; A copy of the Agency Provider Handbook for Home Child Care; Educational opportunities and support services; Payment for the services provided by the Provider in accordance with the rate categories and amounts prescribed by the City of Ottawa; The Agency shall establish the maximum number of children allowed in the Provider’s home in accordance with the Child Care and Early Years Act; RESPONSIBILITIES OF THE PROVIDER 6. The Provider agrees to carry out the following: Provide home child care in accordance with the arrangements agreed upon between the Provider, the Agency and the Parents(s) or Guardian of the child/children; Maintain strict confidentiality with respect to confidential social, health and financial information respecting the child/children who are provided with home child care and to store all written materials of a personal nature in a secure place; Provide home child care in accordance with the requirements of the Child Care and Early Years Act and those prescribed by other government authorities as outlined in the Agency Provider Handbook for Home Child Care; Abide by the administrative practices and procedures described in the Agency Provider Handbook for Home Child Care; Abide the agreed maximum number of children. RELEASE OF CLAIMS 7. The Provider agrees to release the Agency, its officers and employees from any claims of any nature due to injury or loss to the Provider, the property of the Provider, or the Provider’s family. TERMINATION BY THE PROVIDER 8. The Provider agrees to provide the Agency with (2) weeks’ termination notice of the Agreement, unless extenuating circumstances do not permit. TERMINATION BY THE AGENCY 9. The Agency will endeavour to provide two (2) weeks’ termination notice of this Agreement. Termination without notice may occur where the Provider fails to comply with the obligations set out in this Agreement or in the Agency Provider Handbook for Home Child Care, the Behaviour Management Policy for Children’s Village of Ottawa-Carleton or the provisions of the Child Care and Early Years Act.
